General Terms and Conditions

Prerequisites

The online sales described in the General Terms and Conditions are exclusively open to consumers within the meaning of Section 13 of the German Civil Code (BGB) who act on their own account (hereinafter "Customer").

§ 1: Scope

The General Terms and Conditions are applicable to all purchase contracts concluded via the e-commerce area of the website at djonmeyer.de (hereinafter "Online Order") regarding products to be delivered to Germany.

Contracts based on telephone or online orders are only concluded on the basis of the General Terms and Conditions. Regulations deviating from these General Terms and Conditions shall only become part of the contract if this is explicitly confirmed by Djon & Meyer in text form. The provision of services with knowledge of deviating regulations shall not be deemed as explicit confirmation.

Via the website at djonmeyer.de, the Customer can save and/or print the text of these General Terms and Conditions at any time.

§ 2: Contractual Partner of the Customer

Contracts based on online orders are concluded with Djon & Meyer UG (haftungsbeschränkt). The legally required information about Djon & Meyer UG (haftungsbeschränkt) is provided in the e-commerce area of the website at www.djonmeyer.de under Imprint.

§ 3: Information about the Items

Detailed information and the essential characteristics of all products offered by way of online ordering are available at djonmeyer.de. Any photographs, descriptions, and drawings of the products offered for sale are only exemplary and do not become part of the contract.

Additional questions about the products can also be directed to customer service by telephone.

Insignificant but recognizable deviations in color and shape cannot always be avoided. They do not constitute a defect for which Djon & Meyer would have to stand in. Statutory warranty claims remain unaffected.

§ 4: Ordering the Items, Conclusion of Contract and Content of Contract

4.1 Online Orders

Online orders can be placed via the website at djonmeyer.de by selecting an offered product and completing the intended ordering process.

If the Customer has selected a product, they can choose it without obligation by clicking on the corresponding button. They can view the content of the selection at any time by clicking on the corresponding symbol at the top of the website. The Customer can remove products in the selection from the selection at any time.

If the Customer wants to buy the product, they must click the corresponding button and then enter their data. The mandatory information is marked accordingly. The data is transmitted in encrypted form.

After entering the data, the Customer reaches the order page, where they can check their entries again. The Customer can make changes by clicking the "back button" of their browser or the website.

By clicking the button "Buy now", the Customer completes the ordering process. The process can be canceled at any time before clicking the "Buy now" button by closing the browser window.

4.2 Conclusion of Contract and Content of Contract

Djon & Meyer UG (haftungsbeschränkt) reserves the right to reject online orders. In case of rejection of an order by Djon & Meyer UG (haftungsbeschränkt), the Customer incurs no costs, apart from the connection costs (Internet).

Under the statutory requirements, you have the right to information, rectification, and erasure of your personal data, as well as the right to restriction of processing and the right to object to processing by contacting info@djonmeyer.de.

The purchase contract between the Customer and Djon & Meyer UG (haftungsbeschränkt) is concluded by Djon & Meyer UG (haftungsbeschränkt) accepting the offer submitted by the Customer's order. The acceptance by Djon & Meyer UG (haftungsbeschränkt) can be explicitly declared to the Customer by a shipping confirmation sent by e-mail.

If the acceptance is not explicitly declared, the delivery of the ordered products to the Customer shall be deemed as acceptance. The confirmation of receipt of the order is not yet deemed as acceptance.

If the Customer chooses payment by advance payment, the purchase contract is concluded, in deviation from the above regulation, with the request for payment by Djon & Meyer UG (haftungsbeschränkt). In case of payment by credit card, the purchase contract is concluded with the charging of the Customer's credit card according to § 6, if this occurs before shipment of the products or an otherwise declared acceptance.

For online orders, the contract text is not saved by Djon & Meyer UG (haftungsbeschränkt). The contract language is German.

§ 5: Prices and Delivery Costs

All prices include VAT. Unless explicitly stated otherwise in the internet offer of Djon & Meyer UG (haftungsbeschränkt), no delivery costs apply for online orders.

For online orders, the prices shown in the internet offer at djonmeyer.de at the time of the order apply. The amount to be paid by the Customer (product price and, if applicable, delivery costs) is displayed to the Customer as part of the online ordering process.

The Customer receives a written payment confirmation, a breakdown of the price and any delivery costs incurred for each product upon delivery. For online orders, the Customer receives a confirmation of the order receipt and a confirmation of shipment by e-mail.

§ 6: Payment Terms, Invoice

The purchase price payment is made exclusively by credit card payment, payment via PayPal, payment via Apple Pay or SOFORT as a transfer. For payments via PayPal or SOFORT, the Customer is redirected to the website of PayPal or SOFORT during the ordering process to carry out the payment there.

For credit card payments, Visa cards, Eurocard/Mastercard, and American Express cards are accepted.

For security reasons, the billing address for online orders must match the address specified for the credit card. The Customer's credit card will be charged when the order is prepared for shipment.

By using the credit card for the online order, the Customer confirms that they are the holder of the credit card and that it is issued to them. Furthermore, they provide the card number with sixteen or fifteen digits for American Express, the expiration date and, if applicable, the verification number located on the back or front for American Express of their card.

Djon & Meyer UG (haftungsbeschränkt) will send the Customer an invoice for the purchased products. This is done electronically by e-mail to the e-mail address specified during the order.

§ 7: Delivery

The Customer has the opportunity to have products delivered to a natural person of their choice who has their permanent residence in Germany.

For logistical reasons, Djon & Meyer UG (haftungsbeschränkt) does not deliver to addresses on the offshore island of Helgoland (postal codes 27483, 27494 & 27498) as well as in the community of Büsingen am Hochrhein (postal codes 78263, 78264 & 78266). Delivery to hotels, PO boxes, or business addresses is also excluded.

The delivery of Djon & Meyer UG (haftungsbeschränkt) products to the address of the Customer or a recipient designated as above takes place after the payment of the purchase price has been recorded by Djon & Meyer UG (haftungsbeschränkt), provided that Djon & Meyer UG (haftungsbeschränkt) accepts the order.

Djon & Meyer UG (haftungsbeschränkt) delivers products via courier service. Should the packaging be visibly damaged upon delivery, Djon & Meyer UG (haftungsbeschränkt) asks the Customer to open the package in the presence of the carrier to check the condition of the product. If the product is damaged, the Customer should note this on the delivery note. Furthermore, the provisions of § 10 are applicable. The statutory claims of the Customer due to defects are not affected by this.

§ 8: Right of Withdrawal and Return of Products

For an online order, the Customer (consumer) is entitled to a statutory right of withdrawal:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you who is not the carrier has taken possession of the last goods.

To exercise your right of withdrawal, you must inform Djon & Meyer UG (haftungsbeschränkt) (Benninghausen 42, 51399 Burscheid; E-mail: info@djonmeyer.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or e-mail).

You can use the attached model withdrawal form for this purpose, which is however not mandatory. To meet the withdrawal deadline, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, Djon & Meyer UG (haftungsbeschränkt) shall repay you all payments that Djon & Meyer UG (haftungsbeschränkt) has received from you without delay and at the latest within fourteen days from the day on which the returned goods of this contract were received by Djon & Meyer UG (haftungsbeschränkt).

For this repayment, the same means of payment that you used for the original transaction will be used.

You only have to pay for any loss in value of the products if this loss in value is due to a handling of them that is not necessary to check the nature, characteristics, and functioning of the products.

§ 9: Claims for Defects

The Customer is responsible for checking whether the delivered Djon & Meyer UG (haftungsbeschränkt) products match the ordered ones. If the delivered products do not match the ordered ones, it is up to the Customer to inform customer service by e-mail and to return the products concerned.

Unless special assurances, which must be explicitly designated as "guarantees", are made to the Customer with the delivery of the products, the statutory warranty regulations according to §§ 434 ff. BGB are applicable.

§ 10: Complaints – Information

For all information, complaints, and questions regarding online orders or regarding the Djon & Meyer UG (haftungsbeschränkt) products themselves, the Customer can contact the customer service of Djon & Meyer UG (haftungsbeschränkt) by e-mail at info@djonmeyer.de.

§ 11: Data Protection

The protection of personal data is an important concern for Djon & Meyer UG (haftungsbeschränkt). As far as Djon & Meyer UG (haftungsbeschränkt) collects personal data for online orders, these are only used to answer customer inquiries, to process the contracts concluded with the customers and for technical administration.

Djon & Meyer UG (haftungsbeschränkt) is entitled to pass on personal data to third parties as far as this is necessary for the performance of contracts (e.g., for the shipment of ordered products); the use of personal data by such third parties is contractually limited to this action on behalf of Djon & Meyer UG (haftungsbeschränkt).

For online orders, the required personal data results from the online order form in the internet offer of Djon & Meyer UG (haftungsbeschränkt).

To prevent credit card fraud and comparable actions to the detriment of Djon & Meyer UG (haftungsbeschränkt), a check at the respective credit institution is carried out in compliance with the data protection regulations using the systems of the company Stripe, LLC.

For this purpose and for payment processing, personal data of the Customer is transmitted to Stripe, LLC. Stripe, LLC is based in the USA, and Djon & Meyer UG (haftungsbeschränkt) has ensured compliance with the GDPR through contractual agreements with Stripe, LLC. In particular, Stripe LLC is thereafter responsible for the secure storage and automatic processing of information regarding each order, including credit card data.

The Customer has the right to request information about the stored data as well as their erasure or, if applicable, rectification at any time. A written application to Djon & Meyer UG (haftungsbeschränkt) at the address specified in § 10 of the General Terms and Conditions is sufficient for this.

§ 12: Trademarks / Intellectual Property Rights

The trademark "Djon & Meyer" and all other trademarks located on Djon & Meyer UG (haftungsbeschränkt) products, accessories, or packaging are and remain the sole property of the company Djon & Meyer UG (haftungsbeschränkt), regardless of whether they are figurative marks or word marks, illustrations, images, or logotypes, and regardless of whether they are registered or not.

Any complete or partial reproduction, modification, or use of these trademarks, illustrations, images, or logotypes, regardless of the reason and basis, without the explicit and prior consent of the company Djon & Meyer UG (haftungsbeschränkt), is strictly prohibited.

The same applies to any combination or connection with other trademarks, symbols, logotypes and generally any distinctive sign intended to form a composite logo. The same applies to all copyrights, drawings, and models owned by the company Djon & Meyer UG (haftungsbeschränkt).

§ 13: Force Majeure

In the event of an unforeseeable event or force majeure that prevents or delays the execution of the obligations by Djon & Meyer UG (haftungsbeschränkt), the obligation to perform is suspended.

Such events are in particular war, mass riots, uprisings, social unrest, strikes of any kind and delays in the supply of Djon & Meyer UG (haftungsbeschränkt). Djon & Meyer UG (haftungsbeschränkt) informs the Customer immediately of the occurrence of such an event or force majeure.

If the obligations of Djon & Meyer UG (haftungsbeschränkt) are suspended for more than two weeks, the Customer is entitled to withdraw from the contract. The reimbursement of the purchase price takes place according to § 9 of the General Terms and Conditions.

If the ordered products are definitively no longer available, the Customer is entitled to withdraw from the contract without notice.
